關于推進新時代和諧勞動關系創建活動的實施(shi)方案
為進一步加強(qiang)構建和諧勞動(dong)關系(xi)工作(zuo),扎實推進勞動(dong)關系(xi)治理(li)提質增效,按照《關于推進新時代和諧勞動(dong)關系(xi)創(chuang)建活動(dong)的意見》(人社部(bu)發〔2023〕2號)要(yao)求,制定本實施方案。
一(yi)、工作目(mu)標(biao)
在全省各類企(qi)業持續推進(jin)新(xin)時代和諧(xie)勞(lao)(lao)(lao)動關(guan)系(xi)(xi)創建(jian)(jian)活(huo)動,推動企(qi)業貫(guan)徹落實勞(lao)(lao)(lao)動保(bao)障法(fa)律(lv)法(fa)規、完(wan)善勞(lao)(lao)(lao)動關(guan)系(xi)(xi)協商協調機制(zhi)、健全勞(lao)(lao)(lao)動者權益保(bao)障制(zhi)度(du)、促進(jin)和諧(xie)文化建(jian)(jian)設。力爭到(dao)2027年底(di)各類企(qi)業及企(qi)業聚(ju)集區域普遍開(kai)展創建(jian)(jian)活(huo)動,實現(xian)創建(jian)(jian)內容(rong)更(geng)(geng)加(jia)(jia)(jia)豐富、創建(jian)(jian)標準更(geng)(geng)加(jia)(jia)(jia)規范、創建(jian)(jian)評價更(geng)(geng)加(jia)(jia)(jia)科學、創建(jian)(jian)激勵(li)措施更(geng)(geng)加(jia)(jia)(jia)完(wan)善,創建(jian)(jian)企(qi)業基(ji)本達(da)到(dao)創建(jian)(jian)標準,和諧(xie)勞(lao)(lao)(lao)動關(guan)系(xi)(xi)理念得到(dao)廣泛認同,規范有序、公正合理、互利共贏、和諧(xie)穩定的勞(lao)(lao)(lao)動關(guan)系(xi)(xi)進(jin)一步形(xing)成。
二、創建(jian)內容
(一)企(qi)(qi)業(ye)創建(jian)的重點內容(rong)。建(jian)立健全企(qi)(qi)業(ye)黨(dang)組織,充分發揮黨(dang)組織在(zai)和諧(xie)勞(lao)(lao)(lao)(lao)動(dong)(dong)關(guan)系創建(jian)活動(dong)(dong)中(zhong)把(ba)關(guan)定(ding)向、團(tuan)結(jie)凝聚各方(fang)力量的作(zuo)用。全面落實(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同、集(ji)(ji)體合同制(zhi)度,加(jia)強(qiang)企(qi)(qi)業(ye)民主管理,依法保障職工(gong)勞(lao)(lao)(lao)(lao)動(dong)(dong)報酬(chou)、休息休假、勞(lao)(lao)(lao)(lao)動(dong)(dong)安(an)全衛生、社(she)會保險、職業(ye)技能培(pei)(pei)訓等基本權益。建(jian)立職工(gong)工(gong)資集(ji)(ji)體協商和正常增長(chang)機制(zhi),加(jia)強(qiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)保護,改善勞(lao)(lao)(lao)(lao)動(dong)(dong)條件。建(jian)立企(qi)(qi)業(ye)勞(lao)(lao)(lao)(lao)動(dong)(dong)爭議調解委員會,強(qiang)化勞(lao)(lao)(lao)(lao)動(dong)(dong)爭議預(yu)防,促進勞(lao)(lao)(lao)(lao)動(dong)(dong)爭議協商和解。加(jia)強(qiang)人(ren)文關(guan)懷,培(pei)(pei)育企(qi)(qi)業(ye)關(guan)心關(guan)愛職工(gong)、職工(gong)愛崗(gang)愛企(qi)(qi)的企(qi)(qi)業(ye)文化。
(二)工(gong)業園區、鄉鎮(zhen)(街道(dao))創建(jian)(jian)的(de)重點(dian)內容。健全(quan)工(gong)業園區、鄉鎮(zhen)(街道(dao))黨委領導的(de)構建(jian)(jian)和諧勞(lao)(lao)動(dong)關(guan)(guan)(guan)系(xi)工(gong)作機(ji)(ji)制(zhi)(zhi),加強(qiang)對創建(jian)(jian)活動(dong)的(de)組織(zhi)領導,推動(dong)轄區內企(qi)業普遍開展和諧勞(lao)(lao)動(dong)關(guan)(guan)(guan)系(xi)創建(jian)(jian)活動(dong)。建(jian)(jian)立健全(quan)勞(lao)(lao)動(dong)關(guan)(guan)(guan)系(xi)協(xie)(xie)調機(ji)(ji)制(zhi)(zhi)、矛盾調處機(ji)(ji)制(zhi)(zhi)、權益保障機(ji)(ji)制(zhi)(zhi),加強(qiang)勞(lao)(lao)動(dong)保障法律宣傳、用(yong)工(gong)指導服務,搭建(jian)(jian)勞(lao)(lao)動(dong)關(guan)(guan)(guan)系(xi)雙(shuang)方溝通協(xie)(xie)調平臺,及時預(yu)防化(hua)解勞(lao)(lao)動(dong)關(guan)(guan)(guan)系(xi)矛盾糾紛。布(bu)局勞(lao)(lao)動(dong)關(guan)(guan)(guan)系(xi)基層(ceng)公(gong)共服務站(zhan)點(dian),為(wei)企(qi)業和勞(lao)(lao)動(dong)者提供一站(zhan)式、智慧(hui)化(hua)、標準化(hua)勞(lao)(lao)動(dong)關(guan)(guan)(guan)系(xi)公(gong)共服務。
(三)行業創(chuang)建(jian)的重點內(nei)容(rong)。建(jian)立健(jian)全構建(jian)和諧勞(lao)(lao)動(dong)關系(xi)工(gong)作(zuo)機(ji)制(zhi)(zhi),加強對行業內(nei)企業創(chuang)建(jian)活動(dong)的組織(zhi)領導,積極推動(dong)行業內(nei)企業普遍開展和諧勞(lao)(lao)動(dong)關系(xi)創(chuang)建(jian)活動(dong)。建(jian)立健(jian)全勞(lao)(lao)動(dong)關系(xi)協(xie)調(diao)機(ji)制(zhi)(zhi)、矛盾調(diao)處機(ji)制(zhi)(zhi)、權益保(bao)(bao)障(zhang)機(ji)制(zhi)(zhi),加強勞(lao)(lao)動(dong)保(bao)(bao)障(zhang)法(fa)律宣(xuan)傳(chuan)、用工(gong)指導服務,搭建(jian)勞(lao)(lao)動(dong)關系(xi)雙方(fang)溝(gou)通協(xie)調(diao)平(ping)臺(tai),維護職工(gong)基本權益,及時預防化解行業內(nei)勞(lao)(lao)動(dong)關系(xi)矛盾糾紛。
三、創(chuang)建標準(zhun)
根(gen)據本地企業的類型、分布(bu)、職工人數(shu)和勞(lao)動關系狀況以及工業園區、鄉鎮(街道)工作基(ji)礎(chu)和行(xing)業實(shi)際等,分類培育,分步推進。
(一)企業(ye)創建標準
1、企(qi)業(ye)黨(dang)組織健(jian)全(quan),在創建活動中,組織職工(gong)(gong)、宣傳職工(gong)(gong)、凝聚(ju)職工(gong)(gong)、服務職工(gong)(gong)的職能作用發(fa)揮(hui)(hui)充分,黨(dang)員先(xian)鋒模范作用有(you)效(xiao)發(fa)揮(hui)(hui)。
2、企業工(gong)(gong)會(hui)組織健全、運行(xing)順(shun)暢(chang),針(zhen)對工(gong)(gong)資(zi)等職工(gong)(gong)關(guan)心的問題定期開展集(ji)體協商并(bing)簽訂(ding)集(ji)體合同(tong),協商程序(xu)規范(fan)、效果良好,職工(gong)(gong)工(gong)(gong)資(zi)增長與企業效益、勞動生(sheng)產率增長相適應。
3、以職(zhi)(zhi)工(gong)(代表)大(da)會制度為基(ji)本形式的(de)企業(ye)民主管理制度健全,定期召開職(zhi)(zhi)工(gong)(代表)大(da)會,按(an)規定將(jiang)涉(she)及職(zhi)(zhi)工(gong)切身(shen)利益(yi)的(de)規章制度和重(zhong)大(da)事(shi)項經(jing)過職(zhi)(zhi)工(gong)(代表)大(da)會審(shen)議通過,完善廠務公(gong)開制度,公(gong)司制企業(ye)依(yi)法設立職(zhi)(zhi)工(gong)董事(shi)、職(zhi)(zhi)工(gong)監事(shi)。
4、企業勞(lao)動爭(zheng)議調解委員會機構健全、制(zhi)度完善,建立勞(lao)動爭(zheng)議預防(fang)預警(jing)機制(zhi),及時調處(chu)勞(lao)動爭(zheng)議和(he)影響(xiang)勞(lao)動關(guan)系和(he)諧穩定的苗頭性(xing)、傾(qing)向性(xing)問題(ti),促(cu)進勞(lao)動爭(zheng)議協(xie)商和(he)解。
5、職工(gong)(gong)培訓(xun)(xun)(xun)制度健全(quan),制定培訓(xun)(xun)(xun)計劃,采取崗前培訓(xun)(xun)(xun)、學徒培訓(xun)(xun)(xun)、脫產培訓(xun)(xun)(xun)、技(ji)術比武、技(ji)能(neng)競賽等方式,大幅提升職工(gong)(gong)技(ji)能(neng)水平。職工(gong)(gong)教育經費足(zu)額(e)到位,經費60%以上用于企業一線(xian)職工(gong)(gong)的教育和培訓(xun)(xun)(xun)。
6、重(zhong)視企業文化建設,努力培育(yu)與(yu)中華優秀傳統文化相契合富有企業特(te)色的企業精神和健康向上的企業文化,踐行社(she)會主義(yi)核心(xin)價值觀,切實承擔報效家園、服(fu)務社(she)會、造福職(zhi)工的責任。
7、加強對(dui)職(zhi)(zhi)工(gong)的人(ren)文(wen)關懷,不斷改善職(zhi)(zhi)工(gong)的生產和生活(huo)條件,支持和幫助職(zhi)(zhi)工(gong)平(ping)衡工(gong)作和家庭責任,保障(zhang)生育(yu)女(nv)職(zhi)(zhi)工(gong)享有平(ping)等的就業(ye)機會(hui)、職(zhi)(zhi)業(ye)發展機會(hui)和待遇。注重職(zhi)(zhi)工(gong)的精(jing)神需求和心理健(jian)康,建立職(zhi)(zhi)工(gong)健(jian)康服務體系(xi),塑造(zao)職(zhi)(zhi)工(gong)幸福生活(huo)環境,提高職(zhi)(zhi)工(gong)生活(huo)品質。
8、職工愛崗(gang)敬(jing)業、遵守紀律、誠(cheng)實守信(xin),對企業的責任感、認(ren)同感和歸(gui)屬感較強,能夠(gou)正確(que)對待社會利(li)(li)益(yi)關系調整,以理(li)性合法形式表達利(li)(li)益(yi)訴求,維護自身權益(yi)。
9、職工(gong)(gong)滿(man)意(yi)度較高。職工(gong)(gong)對勞動報酬(chou)、社保(bao)繳納、休(xiu)息休(xiu)假、工(gong)(gong)作環(huan)境、技能培訓、勞動條件、協商民主、人文關(guan)懷等指標綜合評價滿(man)意(yi)度高。
(二)工業園區、鄉(xiang)鎮(街道(dao))創建標準(zhun)
1、工(gong)業(ye)園區、鄉(xiang)鎮(街道)黨(dang)委(wei)(wei)領導的構建和諧勞動關系工(gong)作機制健全,將創建活(huo)動納入當地黨(dang)委(wei)(wei)、政府重要議事日(ri)程,制定出臺推進創建活(huo)動的實施方案,完(wan)善政府、工(gong)會、企業(ye)代表組織(zhi)共同參(can)與(yu)的勞動關系協(xie)商協(xie)調機制。
2、轄(xia)區內企業用工管理(li)普遍合法合規,基本達到創建標準。
3、轄區(qu)內企(qi)業普遍(bian)建立以工資(zi)集體(ti)(ti)協商(shang)為重點的集體(ti)(ti)合同制(zhi)度,對不(bu)具備(bei)單獨開展條件(jian)的小微企(qi)業,通(tong)過簽訂區(qu)域性(xing)、行(xing)業性(xing)集體(ti)(ti)合同實現覆蓋。
4、依(yi)法建立工(gong)會組(zu)織、企業代(dai)表組(zu)織以及勞(lao)動爭(zheng)議(yi)調(diao)解(jie)(jie)組(zu)織,健全勞(lao)動關(guan)系矛盾糾紛排查(cha)預防和(he)(he)聯動化解(jie)(jie)機(ji)(ji)制,對轄區內帶有普遍性、傾向性的勞(lao)動關(guan)系問(wen)題(ti)開展協(xie)商,預防和(he)(he)調(diao)處勞(lao)動爭(zheng)議(yi)。建立健全突發性、集體性勞(lao)動爭(zheng)議(yi)應(ying)急調(diao)解(jie)(jie)協(xie)調(diao)機(ji)(ji)制和(he)(he)重大勞(lao)動爭(zheng)議(yi)信息報告制度(du),及時(shi)化解(jie)(jie)矛盾和(he)(he)糾紛。
5、成立廠務公開協調領導機構,轄區內企業(ye)普遍建立以職(zhi)工代表大會為基本形式的(de)企業(ye)民主管理(li)制度,對不具備單獨(du)建立條(tiao)件的(de)小微企業(ye),通過區域性(行業(ye))職(zhi)代會實(shi)現覆蓋(gai)。
6、轄區(qu)內防(fang)范和處置重(zhong)大安全生產、重(zhong)大職業危害事故以及重(zhong)大勞(lao)動關系群體性(xing)、突發性(xing)事件(jian)的(de)機制健全有效。
7、根據轄(xia)區內企業(ye)規(gui)模,合理(li)布(bu)局勞動關系基(ji)層公共服(fu)(fu)務(wu)站點,達到服(fu)(fu)務(wu)標識統一、服(fu)(fu)務(wu)場(chang)所固定(ding)、服(fu)(fu)務(wu)設(she)施(shi)齊全(quan)、服(fu)(fu)務(wu)內容完備(bei),配備(bei)一定(ding)數(shu)量(liang)的(de)勞動關系協調員,經常性(xing)地(di)(di)對(dui)轄(xia)區內企業(ye)創建活動進行(xing)督促(cu)指導服(fu)(fu)務(wu),定(ding)期組織培訓(xun)、交流(liu)、觀摩等活動,通過線上線下(xia)多種方式提升(sheng)服(fu)(fu)務(wu)效(xiao)能,形成(cheng)地(di)(di)域(yu)、行(xing)業(ye)特(te)色(se)鮮明的(de)公共服(fu)(fu)務(wu)品牌。
(三)行業創(chuang)建標準
本區域內行業(ye)(ye)(ye)創建(jian)機制健全(quan),協商協調成效(xiao)明顯,行業(ye)(ye)(ye)內企業(ye)(ye)(ye)總體規范,矛盾(dun)糾紛(fen)調處(chu)順暢有效(xiao)。(詳見附件3)
四、時(shi)間(jian)進(jin)度
(一)安排部(bu)署(2023年1-3月)。省協調(diao)勞(lao)動(dong)(dong)關(guan)系(xi)三(san)方(fang)制(zhi)定(ding)下發《關(guan)于推進(jin)新時代(dai)和諧勞(lao)動(dong)(dong)關(guan)系(xi)創(chuang)(chuang)建活(huo)(huo)動(dong)(dong)的實施方(fang)案(an)》,對全省創(chuang)(chuang)建活(huo)(huo)動(dong)(dong)進(jin)行安排部(bu)署。各市(shi)結合當地實際,制(zhi)定(ding)具體工作(zuo)方(fang)案(an),對全市(shi)創(chuang)(chuang)建活(huo)(huo)動(dong)(dong)進(jin)行安排部(bu)署,2023年3月底前將工作(zuo)方(fang)案(an)報(bao)省勞(lao)動(dong)(dong)關(guan)系(xi)協調(diao)委員會辦公室。(責(ze)任單位:省人(ren)社廳、省總工會、省企(qi)聯、省工商聯)
(二)開展(zhan)創(chuang)建(jian)(2023年(nian)4月—2027年(nian)底(di))。在各(ge)級勞動關系(xi)協調三方(fang)的指導下,各(ge)級各(ge)類企業(ye)(ye)(ye)和工業(ye)(ye)(ye)園區、鄉鎮(街(jie)道)、行業(ye)(ye)(ye)對照創(chuang)建(jian)內容、創(chuang)建(jian)標準(zhun)自行開展(zhan)創(chuang)建(jian)活動,努力實現(xian)勞動關系(xi)生態良好、和諧(xie)融(rong)洽。(責任單位:省人社(she)廳、省總工會、省企聯(lian)、省工商聯(lian),各(ge)企業(ye)(ye)(ye)、工業(ye)(ye)(ye)園區、鄉鎮/街(jie)道、行業(ye)(ye)(ye))
(三(san))評(ping)(ping)(ping)(ping)估(gu)(gu)驗(yan)收(shou)(2023年12月-2027年底)。每(mei)年底各級(ji)勞(lao)(lao)動(dong)關系(xi)協(xie)調三(san)方(fang)(fang)(fang)對(dui)轄區(qu)內(nei)企(qi)(qi)業、工業園(yuan)區(qu)、鄉鎮(街(jie)道(dao)(dao))、行(xing)(xing)業開(kai)展(zhan)(zhan)創建(jian)活動(dong)情(qing)況進行(xing)(xing)評(ping)(ping)(ping)(ping)估(gu)(gu)驗(yan)收(shou)。企(qi)(qi)業、工業園(yuan)區(qu)、鄉鎮(街(jie)道(dao)(dao))、行(xing)(xing)業對(dui)照評(ping)(ping)(ping)(ping)估(gu)(gu)表(biao)(詳(xiang)見附件(jian)1、2、3)先行(xing)(xing)開(kai)展(zhan)(zhan)自(zi)我評(ping)(ping)(ping)(ping)價,達(da)標(biao)單位(wei)向當地(di)勞(lao)(lao)動(dong)關系(xi)協(xie)調三(san)方(fang)(fang)(fang)申報(bao)(bao),并附自(zi)評(ping)(ping)(ping)(ping)表(biao)。當地(di)勞(lao)(lao)動(dong)關系(xi)協(xie)調三(san)方(fang)(fang)(fang)進行(xing)(xing)評(ping)(ping)(ping)(ping)估(gu)(gu)驗(yan)收(shou)后,將驗(yan)收(shou)達(da)標(biao)單位(wei)報(bao)(bao)上(shang)級(ji)勞(lao)(lao)動(dong)關系(xi)協(xie)調三(san)方(fang)(fang)(fang)辦公室(shi),并附評(ping)(ping)(ping)(ping)估(gu)(gu)表(biao)。經省(sheng)(sheng)勞(lao)(lao)動(dong)關系(xi)協(xie)調三(san)方(fang)(fang)(fang)研究確定為(wei)達(da)標(biao)單位(wei)的,在(zai)全省(sheng)(sheng)范圍內(nei)通報(bao)(bao)。(責(ze)任單位(wei):省(sheng)(sheng)人(ren)社廳、省(sheng)(sheng)總工會(hui)、省(sheng)(sheng)企(qi)(qi)聯(lian)、省(sheng)(sheng)工商聯(lian))
(四(si))總結(jie)推廣(2027年底前(qian))。各市對新時代和諧勞(lao)動關系創(chuang)建活動進行(xing)全面總結(jie),梳理主要做法、取得成效、存在不(bu)足和典型(xing)案(an)例報送省(sheng)(sheng)勞(lao)動關系協(xie)調(diao)委員會辦公室。各級協(xie)調(diao)勞(lao)動關系三方對轄區內創(chuang)建典型(xing)案(an)例,及時加強宣傳推廣,發(fa)揮(hui)示(shi)范引(yin)領作用(yong)。(責任單位(wei):省(sheng)(sheng)人社廳、省(sheng)(sheng)總工(gong)會、省(sheng)(sheng)企聯(lian)、省(sheng)(sheng)工(gong)商聯(lian))
五、保障措施
(一)建(jian)(jian)立(li)健全機制。建(jian)(jian)立(li)健全創(chuang)(chuang)建(jian)(jian)評(ping)(ping)(ping)(ping)(ping)價(jia)(jia)機制,科學設置創(chuang)(chuang)建(jian)(jian)標準(zhun)指標體(ti)系,明確評(ping)(ping)(ping)(ping)(ping)價(jia)(jia)項目、評(ping)(ping)(ping)(ping)(ping)價(jia)(jia)標準(zhun),定(ding)期開展(zhan)創(chuang)(chuang)建(jian)(jian)評(ping)(ping)(ping)(ping)(ping)估(gu)(gu)(gu),引(yin)導企(qi)業(ye)、工(gong)業(ye)園區、鄉鎮(街道)對(dui)照(zhao)創(chuang)(chuang)建(jian)(jian)標準(zhun)開展(zhan)自我(wo)評(ping)(ping)(ping)(ping)(ping)價(jia)(jia),由當(dang)地協調(diao)勞(lao)(lao)動關(guan)系三(san)方對(dui)其是否(fou)達(da)標進行評(ping)(ping)(ping)(ping)(ping)估(gu)(gu)(gu)。健全創(chuang)(chuang)建(jian)(jian)示范單(dan)位評(ping)(ping)(ping)(ping)(ping)審評(ping)(ping)(ping)(ping)(ping)估(gu)(gu)(gu)制度,在堅(jian)持協調(diao)勞(lao)(lao)動關(guan)系三(san)方定(ding)期集中(zhong)評(ping)(ping)(ping)(ping)(ping)審的(de)基礎上(shang),探索引(yin)入社(she)(she)會第三(san)方機構開展(zhan)日常綜合(he)評(ping)(ping)(ping)(ping)(ping)估(gu)(gu)(gu),形成協調(diao)勞(lao)(lao)動關(guan)系三(san)方評(ping)(ping)(ping)(ping)(ping)審為(wei)主、社(she)(she)會評(ping)(ping)(ping)(ping)(ping)估(gu)(gu)(gu)為(wei)補充(chong)的(de)和諧勞(lao)(lao)動關(guan)系評(ping)(ping)(ping)(ping)(ping)審評(ping)(ping)(ping)(ping)(ping)估(gu)(gu)(gu)機制和規范統(tong)一的(de)綜合(he)評(ping)(ping)(ping)(ping)(ping)價(jia)(jia)體(ti)系,提高評(ping)(ping)(ping)(ping)(ping)審評(ping)(ping)(ping)(ping)(ping)估(gu)(gu)(gu)的(de)客觀權威性(xing)、科學合(he)理性(xing)和社(she)(she)會公信(xin)力。
(二)開展(zhan)檢查(cha)督導(dao)(dao)。各(ge)級協調(diao)勞動(dong)(dong)關(guan)系三(san)方要采(cai)取系統檢查(cha)與聯合(he)檢查(cha)相(xiang)結合(he)、自我檢查(cha)與上級抽查(cha)相(xiang)結合(he)、綜合(he)檢查(cha)和專(zhuan)項檢查(cha)相(xiang)結合(he)的(de)方法,重點(dian)對(dui)創建(jian)活動(dong)(dong)部署(shu)、創建(jian)活動(dong)(dong)進(jin)(jin)度(du)、創建(jian)活動(dong)(dong)舉措、創建(jian)活動(dong)(dong)成效(xiao)等進(jin)(jin)行(xing)檢查(cha)督導(dao)(dao),及時(shi)研究(jiu)解決創建(jian)活動(dong)(dong)中遇到的(de)新情況新問題,推(tui)動(dong)(dong)創建(jian)活動(dong)(dong)走穩走深走實。省級勞動(dong)(dong)關(guan)系協調(diao)三(san)方適時(shi)對(dui)各(ge)市創建(jian)活動(dong)(dong)情況進(jin)(jin)行(xing)聯合(he)督導(dao)(dao)。
(三(san))落實激勵(li)措施。對(dui)創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)活動中表現突(tu)出的(de)(de)工(gong)作(zuo)機(ji)構、社會(hui)(hui)組織、企(qi)(qi)業(ye)(ye)、工(gong)業(ye)(ye)園區和鄉(xiang)鎮(街道(dao))、行(xing)業(ye)(ye)及(ji)其相(xiang)關(guan)工(gong)作(zuo)人員(yuan),在國(guo)(guo)(guo)(guo)家協(xie)調勞(lao)(lao)動關(guan)系三(san)方(fang)會(hui)(hui)議每三(san)年(nian)開(kai)展(zhan)(zhan)一(yi)屆的(de)(de)“全國(guo)(guo)(guo)(guo)和諧勞(lao)(lao)動關(guan)系創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)示范企(qi)(qi)業(ye)(ye)、工(gong)業(ye)(ye)園區”創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)活動和每五年(nian)開(kai)展(zhan)(zhan)一(yi)屆“全國(guo)(guo)(guo)(guo)和諧勞(lao)(lao)動關(guan)系創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)工(gong)作(zuo)先(xian)進(jin)(jin)(jin)集體、先(xian)進(jin)(jin)(jin)個(ge)人”表彰時(shi),省級協(xie)調勞(lao)(lao)動關(guan)系三(san)方(fang)將對(dui)全省創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)活動成績(ji)突(tu)出的(de)(de)單位(wei)(wei)和個(ge)人積(ji)極向國(guo)(guo)(guo)(guo)家推(tui)薦申(shen)報(bao)。有條(tiao)件(jian)的(de)(de)市(shi)縣(xian)可給(gei)予和諧勞(lao)(lao)動關(guan)系創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)先(xian)進(jin)(jin)(jin)單位(wei)(wei)和個(ge)人一(yi)定的(de)(de)物質獎(jiang)勵(li)。對(dui)符(fu)合條(tiao)件(jian)的(de)(de)企(qi)(qi)業(ye)(ye),優(you)化人社公(gong)(gong)共服務方(fang)式(shi)和手段(duan),開(kai)展(zhan)(zhan)一(yi)對(dui)一(yi)用(yong)工(gong)“診斷”,提供定制化企(qi)(qi)業(ye)(ye)薪酬數據服務,開(kai)通(tong)人社公(gong)(gong)共服務經辦快速(su)通(tong)道(dao),優(you)化各(ge)項補(bu)貼申(shen)領和辦理(li)流(liu)程,及(ji)時(shi)落實職(zhi)業(ye)(ye)培(pei)訓補(bu)貼、失(shi)業(ye)(ye)保險穩崗返還(huan)、社會(hui)(hui)保險補(bu)貼等政策。對(dui)達(da)到創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)標準且符(fu)合守法誠信等級要(yao)求的(de)(de)企(qi)(qi)業(ye)(ye),適(shi)當減少勞(lao)(lao)動保障(zhang)監(jian)察和社會(hui)(hui)保險稽核日常巡視檢查(cha)頻次,勞(lao)(lao)動爭議調解仲裁機(ji)構主(zhu)動上門(men)開(kai)展(zhan)(zhan)政策調研指導,開(kai)辟勞(lao)(lao)動爭議案件(jian)辦理(li)綠色(se)通(tong)道(dao)。將達(da)到創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)標準的(de)(de)企(qi)(qi)業(ye)(ye)作(zuo)為推(tui)薦和評選全國(guo)(guo)(guo)(guo)五一(yi)勞(lao)(lao)動獎(jiang)狀、全國(guo)(guo)(guo)(guo)廠(chang)務公(gong)(gong)開(kai)民主(zhu)管理(li)先(xian)進(jin)(jin)(jin)單位(wei)(wei)和示范單位(wei)(wei)、信用(yong)企(qi)(qi)業(ye)(ye)、全國(guo)(guo)(guo)(guo)企(qi)(qi)業(ye)(ye)優(you)秀文(wen)化成果(guo)、全國(guo)(guo)(guo)(guo)就業(ye)(ye)與社會(hui)(hui)保障(zhang)先(xian)進(jin)(jin)(jin)民營(ying)企(qi)(qi)業(ye)(ye)、全國(guo)(guo)(guo)(guo)關(guan)愛員(yuan)工(gong)優(you)秀民營(ying)企(qi)(qi)業(ye)(ye)家等榮譽(yu)的(de)(de)重要(yao)參(can)考因素。有條(tiao)件(jian)的(de)(de)市(shi)縣(xian)可給(gei)予和諧勞(lao)(lao)動關(guan)系創(chuang)(chuang)(chuang)(chuang)(chuang)建(jian)(jian)先(xian)進(jin)(jin)(jin)單位(wei)(wei)和個(ge)人一(yi)定的(de)(de)物質獎(jiang)勵(li)。
(四)實施(shi)動(dong)(dong)(dong)(dong)態(tai)(tai)管理。建(jian)(jian)立創(chuang)建(jian)(jian)單位(wei)定(ding)(ding)點聯系(xi)(xi)(xi)培育機(ji)制,加強(qiang)日常跟蹤服(fu)務和(he)監督管理,督促創(chuang)建(jian)(jian)達標(biao)單位(wei)在持續鞏固已有成效(xiao)的(de)基礎(chu)上,不(bu)斷提升創(chuang)建(jian)(jian)水平(ping)。健(jian)全創(chuang)建(jian)(jian)示范(fan)單位(wei)的(de)動(dong)(dong)(dong)(dong)態(tai)(tai)退出機(ji)制,由省(sheng)級(ji)協(xie)調(diao)(diao)(diao)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)(xi)(xi)三方采(cai)取抽查、普查等(deng)方式(shi),充分利用勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)保障(zhang)監察和(he)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)爭議(yi)調(diao)(diao)(diao)解仲(zhong)裁案件以及(ji)(ji)群(qun)體(ti)訪、群(qun)體(ti)性(xing)事(shi)件、集(ji)體(ti)停工事(shi)件等(deng)信息(xi),加大(da)(da)動(dong)(dong)(dong)(dong)態(tai)(tai)精準核(he)查力度,定(ding)(ding)期對(dui)已命(ming)名(ming)的(de)示范(fan)單位(wei)進(jin)行核(he)查。對(dui)因未(wei)依法簽訂勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同、繳納社(she)會(hui)保險費、超時加班(ban)、拖(tuo)欠工資(zi)等(deng)構(gou)成重大(da)(da)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)保障(zhang)違(wei)法行為,以及(ji)(ji)引發較大(da)(da)影響的(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)(xi)(xi)群(qun)體(ti)性(xing)事(shi)件、極(ji)端惡性(xing)事(shi)件、重大(da)(da)安全生產和(he)職(zhi)業危害事(shi)故、負面網絡輿情的(de)全國(guo)和(he)諧勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)(xi)(xi)創(chuang)建(jian)(jian)示范(fan)單位(wei),由省(sheng)級(ji)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)(xi)(xi)協(xie)調(diao)(diao)(diao)三方報國(guo)家協(xie)調(diao)(diao)(diao)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)(xi)(xi)三方同意后,取消命(ming)名(ming),收回(hui)銘牌,并在全省(sheng)范(fan)圍內向(xiang)社(she)會(hui)公(gong)布。
六(liu)、工作要求
(一(yi))加強(qiang)(qiang)組織(zhi)領(ling)導(dao)。各級(ji)協調勞動(dong)(dong)關(guan)系(xi)三方要把創(chuang)建(jian)活(huo)動(dong)(dong)作(zuo)為新時代構(gou)建(jian)中(zhong)國特色和(he)諧勞動(dong)(dong)關(guan)系(xi)的(de)(de)一(yi)項重(zhong)要任務,擺(bai)在突出位置(zhi),采取有(you)力措施,增強(qiang)(qiang)創(chuang)建(jian)實效。要在黨(dang)委、政府的(de)(de)統一(yi)領(ling)導(dao)下,健(jian)全組織(zhi)領(ling)導(dao)機制(zhi)(zhi),推動(dong)(dong)形成黨(dang)委領(ling)導(dao)、政府負責、社會(hui)(hui)協同、企業和(he)職工參與、法治保障的(de)(de)工作(zuo)格局(ju)。要積(ji)極(ji)爭取黨(dang)委、政府重(zhong)視支持,將(jiang)創(chuang)建(jian)活(huo)動(dong)(dong)納入當地經濟社會(hui)(hui)發展(zhan)總(zong)體規劃和(he)政府目標責任考核體系(xi),確(que)保專項經費投(tou)入。要選定代表性強(qiang)(qiang)、積(ji)極(ji)性高的(de)(de)企業、工業園區、鄉鎮(街道(dao))等(deng)單位先(xian)期開展(zhan)創(chuang)建(jian)活(huo)動(dong)(dong),并認真(zhen)研究(jiu)制(zhi)(zhi)定創(chuang)建(jian)方案,精(jing)心組織(zhi)創(chuang)建(jian)活(huo)動(dong)(dong)。
(二)注(zhu)重協(xie)(xie)調(diao)(diao)(diao)配合(he)。各(ge)級協(xie)(xie)調(diao)(diao)(diao)勞(lao)(lao)動(dong)(dong)(dong)關系(xi)(xi)(xi)三方(fang)(fang)要(yao)(yao)(yao)加強對創建(jian)(jian)活(huo)動(dong)(dong)(dong)的(de)部署(shu)、組(zu)織、調(diao)(diao)(diao)度(du),發揮(hui)三方(fang)(fang)機制優勢(shi),形成(cheng)工(gong)(gong)(gong)作(zuo)(zuo)合(he)力,推動(dong)(dong)(dong)創建(jian)(jian)活(huo)動(dong)(dong)(dong)深入開展。人(ren)社部門(men)要(yao)(yao)(yao)牽頭做好創建(jian)(jian)活(huo)動(dong)(dong)(dong)的(de)組(zu)織、協(xie)(xie)調(diao)(diao)(diao)、調(diao)(diao)(diao)研、督(du)導和服務工(gong)(gong)(gong)作(zuo)(zuo),完善(shan)創建(jian)(jian)活(huo)動(dong)(dong)(dong)的(de)申報、備案(an)、資料建(jian)(jian)檔、評價評審、動(dong)(dong)(dong)態調(diao)(diao)(diao)整等(deng)日常管理臺賬,定期通(tong)報創建(jian)(jian)活(huo)動(dong)(dong)(dong)信息。工(gong)(gong)(gong)會組(zu)織要(yao)(yao)(yao)強化對職(zhi)(zhi)工(gong)(gong)(gong)群眾的(de)思想政治(zhi)引領,健全聯(lian)系(xi)(xi)(xi)廣泛、服務職(zhi)(zhi)工(gong)(gong)(gong)的(de)工(gong)(gong)(gong)作(zuo)(zuo)體系(xi)(xi)(xi),為職(zhi)(zhi)工(gong)(gong)(gong)提供法(fa)律(lv)援助、政策(ce)咨詢(xun)、協(xie)(xie)商培(pei)訓(xun)、職(zhi)(zhi)業(ye)道德教育(yu)等(deng)服務,監(jian)督(du)企(qi)(qi)(qi)(qi)業(ye)落實(shi)勞(lao)(lao)動(dong)(dong)(dong)保障法(fa)律(lv)法(fa)規(gui),引導職(zhi)(zhi)工(gong)(gong)(gong)以理性合(he)法(fa)形式(shi)表(biao)達利益(yi)(yi)訴(su)求、解決利益(yi)(yi)矛盾、維護自身權益(yi)(yi)。企(qi)(qi)(qi)(qi)業(ye)代(dai)表(biao)組(zu)織要(yao)(yao)(yao)加強基層企(qi)(qi)(qi)(qi)業(ye)代(dai)表(biao)組(zu)織建(jian)(jian)設(she),充(chong)分發揮(hui)企(qi)(qi)(qi)(qi)業(ye)代(dai)表(biao)組(zu)織對企(qi)(qi)(qi)(qi)業(ye)經營者的(de)團結(jie)、服務、引導、教育(yu)作(zuo)(zuo)用,根據企(qi)(qi)(qi)(qi)業(ye)特點提供“診斷式(shi)”、全流程、多樣化、多層次的(de)服務指導,教育(yu)引導廣大企(qi)(qi)(qi)(qi)業(ye)經營者主動(dong)(dong)(dong)承擔社會責任。
(三)強化宣(xuan)傳(chuan)引(yin)(yin)導(dao)。各(ge)級協(xie)調勞(lao)動(dong)(dong)(dong)關系三方要加強與(yu)主流媒(mei)體(ti)(ti)、新媒(mei)體(ti)(ti)的協(xie)同配合,將創(chuang)建(jian)(jian)(jian)活(huo)(huo)動(dong)(dong)(dong)與(yu)宣(xuan)傳(chuan)工(gong)作一體(ti)(ti)謀劃、一體(ti)(ti)推進(jin),通過設(she)立(li)宣(xuan)傳(chuan)月、開(kai)(kai)設(she)宣(xuan)傳(chuan)專(zhuan)欄(lan)、組織業務技(ji)能(neng)競賽、舉辦巡回演講、開(kai)(kai)展(zhan)主題(ti)征(zheng)文和(he)攝影作品征(zheng)集、拍攝專(zhuan)題(ti)片、培育(yu)教育(yu)實(shi)踐基地等方式(shi)(shi),全(quan)景式(shi)(shi)、立(li)體(ti)(ti)化、多角度、持續性展(zhan)現(xian)(xian)創(chuang)建(jian)(jian)(jian)活(huo)(huo)動(dong)(dong)(dong)的生動(dong)(dong)(dong)實(shi)踐和(he)昂揚氣派,用心用情用力(li)(li)打造(zao)創(chuang)建(jian)(jian)(jian)活(huo)(huo)動(dong)(dong)(dong)特(te)色品牌,提高全(quan)社會對(dui)創(chuang)建(jian)(jian)(jian)活(huo)(huo)動(dong)(dong)(dong)的認知度、參與(yu)度和(he)美譽度。要大力(li)(li)宣(xuan)傳(chuan)創(chuang)建(jian)(jian)(jian)活(huo)(huo)動(dong)(dong)(dong)涌現(xian)(xian)出來(lai)的先進(jin)典型和(he)先進(jin)事跡,發揮(hui)榜樣(yang)示范作用,擴大創(chuang)建(jian)(jian)(jian)活(huo)(huo)動(dong)(dong)(dong)的傳(chuan)播力(li)(li)、引(yin)(yin)導(dao)力(li)(li)和(he)影響力(li)(li),營造(zao)共(gong)商共(gong)建(jian)(jian)(jian)共(gong)享和(he)諧勞(lao)動(dong)(dong)(dong)關系的良好社會氛(fen)圍。
