據人社部調(diao)解仲裁管理(li)司有關負(fu)責人介紹,這一批六件案例覆(fu)蓋平臺(tai)經濟主要行業(ye)類型和(he)常見用工方式(shi),對于(yu)切實(shi)提高新就業(ye)形態勞動(dong)爭議(yi)案件辦理(li)質效、充(chong)分實(shi)現平臺(tai)經濟良性(xing)發展與勞動(dong)者權益保護互促(cu)共(gong)進具有重要意義。
這位負(fu)責人表示,案(an)例堅持“事(shi)實(shi)(shi)優(you)先(xian)”的勞(lao)(lao)(lao)動(dong)(dong)關(guan)系認定原則,根(gen)據用工(gong)事(shi)實(shi)(shi)認定企業(ye)和勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)的關(guan)系;明確“從屬(shu)(shu)性(xing)(xing)+要素(su)式”的勞(lao)(lao)(lao)動(dong)(dong)關(guan)系認定思路(lu),結合平(ping)臺(tai)實(shi)(shi)際用工(gong)中勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)對(dui)(dui)工(gong)作時間及工(gong)作量的自主決定程度(du)(du)等要素(su),全面分析勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)與企業(ye)之間的人格從屬(shu)(shu)性(xing)(xing)、經(jing)濟從屬(shu)(shu)性(xing)(xing)、組織從屬(shu)(shu)性(xing)(xing),加強對(dui)(dui)勞(lao)(lao)(lao)動(dong)(dong)管理程度(du)(du)的綜合考量,對(dui)(dui)符合確立勞(lao)(lao)(lao)動(dong)(dong)關(guan)系情形(xing)的認定標準作出重點規范;對(dui)(dui)通過(guo)訂(ding)立民事(shi)合作協議規避用人單位義務、“假外包真用工(gong)”、誘導勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)注冊個體工(gong)商(shang)戶等違法用工(gong)行為予以(yi)糾正,切實(shi)(shi)維護勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)合法權益。
“下一步我們(men)將和最高法繼續加強對(dui)(dui)新就業(ye)形態(tai)勞(lao)(lao)動(dong)爭(zheng)議案(an)件辦(ban)理(li)工作(zuo)的聯合調研,積極推動(dong)新就業(ye)形態(tai)勞(lao)(lao)動(dong)者勞(lao)(lao)動(dong)保障權益法律(lv)政策完(wan)善(shan),加大對(dui)(dui)勞(lao)(lao)動(dong)人事爭(zheng)議仲裁機構和人民法院辦(ban)案(an)指導力(li)度,通過爭(zheng)議案(an)件辦(ban)理(li)引導平(ping)臺及其合作(zuo)企業(ye)依法規范用工、勞(lao)(lao)動(dong)者理(li)性維權。”這(zhe)位(wei)負責人說。
